PHOTOGRAPHY TERMS & CONDITIONS

These Terms & Conditions apply to all photography services provided by CreativeAce Pty Ltd. By making a booking, paying a booking fee/deposit, or using our photography services, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.

1. BOOKINGS & CONFIRMATION

A photography session is only considered confirmed once the required booking fee/deposit has been received and the booking has been accepted by us.

Submitting a booking request without making the required payment does not guarantee or reserve a date or time.

Dates and times are allocated on a first-confirmed, first-served basis.

2. BOOKING FEE / DEPOSIT

A booking fee or deposit may be required to secure your selected date and time.

The booking fee reserves the Photographer's time and prevents the selected time slot from being offered to another client.

Unless otherwise stated or required by applicable law, booking fees are non-refundable where the Photographer has reserved the agreed date and time and is ready and able to provide the booked service.

Any outstanding balance must be paid by the date specified on the invoice, booking confirmation, or package information.

3. CANCELLATIONS

Clients who wish to cancel a photography session must notify us as soon as possible.

Any refund or cancellation charge will be handled in accordance with the booking terms and applicable South African consumer law.

Where costs have already been incurred specifically for the Client's booking, including studio, venue, travel, accommodation, assistant, equipment, or supplier costs, these may be deducted from any refund where legally permitted.

4. RESCHEDULING

Clients may request to reschedule their session by contacting us as early as possible.

Rescheduling is subject to availability and is not guaranteed.

A new date must be agreed upon by both the Client and Photographer.

Additional costs may apply where rescheduling results in additional studio, venue, travel, supplier, or other third-party charges.

5. LATE ARRIVALS

Clients are responsible for arriving on time for their scheduled session.

If a Client arrives late, the session may still end at the originally scheduled finishing time, particularly where another booking follows.

Late arrival therefore may result in reduced shooting time and fewer photographs.

Where the Client is significantly late and the session cannot reasonably proceed, the booking may be treated as a cancellation or rescheduling request.

6. NO-SHOWS

If a Client fails to arrive for a confirmed session without prior communication, the session may be considered a no-show.

Any booking fee or amounts already incurred in connection with the reserved session may be retained where permitted by applicable law.

A new booking and payment may be required to arrange another session.

7. STUDIO & LOCATION FEES

Studio hire, venue entrance fees, permits, parking charges, travel expenses and other location-related costs may not be included unless specifically stated in the selected photography package.

The Client will be informed of known additional charges where reasonably possible before the session.

8. TRAVEL

Photography outside our standard service area may attract an additional travel fee.

For long-distance bookings, accommodation, flights, toll fees or other reasonable travel expenses may also be charged where applicable and agreed with the Client.

9. WEATHER & OUTDOOR SESSIONS

Outdoor photography is subject to weather conditions.

If weather conditions make a session unsafe or unsuitable, the Photographer and Client may agree to reschedule the session or move it to a suitable alternative location.

Weather-related decisions will be made with reasonable consideration for safety, photography conditions and availability.

10. CLIENT RESPONSIBILITIES

The Client is responsible for arriving prepared for the session, including clothing, makeup, hair, accessories and personal items unless these services are specifically included in the package.

The Client must inform the Photographer in advance of any important requirements, restrictions or specific photographs required.

For events and weddings, the Client should identify important people, moments or photographs that must receive particular attention.

11. CHILDREN & MINORS

A parent or legal guardian must provide the necessary consent for photography involving minors.

A responsible adult should remain present where reasonably required during sessions involving children.

The Photographer is not responsible for supervising children during a photography session.

12. IMAGE SELECTION

The Photographer has creative discretion when selecting the final photographs delivered to the Client.

Images that are duplicates, test shots, out of focus, affected by blinking, technically unsuitable or otherwise not representative of the Photographer's professional standard may be excluded.

The number of final photographs supplied will be determined by the selected package or written agreement.

13. EDITING & RETOUCHING

Delivered photographs may receive professional editing, including colour correction, exposure adjustment, cropping and other adjustments consistent with our photography style.

Advanced retouching, body alterations, object removal, background replacement, extensive skin retouching or other specialised editing may attract an additional fee.

The Photographer retains reasonable creative discretion over the final editing style.

14. RAW / UNEDITED FILES

RAW, original or unedited photographs are not included in the standard photography package unless expressly agreed in writing.

The Client receives the final edited photographs specified in their selected package.

15. DELIVERY OF PHOTOGRAPHS

Final photographs will normally be delivered digitally through an online gallery, cloud storage service, download link or another agreed delivery method.

Estimated turnaround times may vary depending on the type and size of the booking.

Any delivery timeframe provided is an estimate unless expressly guaranteed in writing.

16. ONLINE GALLERY & DOWNLOADS

Where photographs are delivered through an online gallery or temporary download link, the Client is responsible for downloading and securely backing up their photographs before the link expires.

We recommend keeping copies of your photographs on more than one storage device or cloud service.

We do not guarantee indefinite storage of Client photographs after final delivery.

17. COPYRIGHT

Unless otherwise agreed in writing, copyright in photographs created by the Photographer remains with the Photographer in accordance with applicable copyright law.

The Client receives permission to use delivered photographs for personal purposes, including printing and sharing on personal social media accounts.

Commercial use, resale, publication, advertising or use by third-party businesses may require additional written permission or licensing.

18. SOCIAL MEDIA & PORTFOLIO USE

The Photographer may request permission to use selected photographs for portfolio, website, social media, advertising, competitions, exhibitions and promotional purposes.

Where consent is required, the Client's images will be used in accordance with the consent provided and applicable privacy law.

Clients who do not want their photographs used publicly should communicate this preference to the Photographer.

19. IMAGE ALTERATION & FILTERS

Clients are encouraged not to apply heavy filters or significant alterations to professionally edited photographs where the resulting image may misrepresent the Photographer's work.

Where photographs are being used commercially or credited to the Photographer, material alterations should be discussed with us beforehand.

20. LOSS OR TECHNICAL FAILURE

We take reasonable precautions to protect photographs and photography equipment.

However, circumstances outside reasonable control may occasionally occur, including equipment failure, storage corruption, theft, accidents or other unforeseen technical problems.

Where photographs are lost or cannot be delivered due to circumstances attributable to the Photographer, any remedy will be determined according to the circumstances, the agreement and applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded under South African law.

21. FORCE MAJEURE & EMERGENCIES

The Photographer will not be responsible for failure or delay caused by circumstances reasonably beyond their control, including serious illness, accidents, natural disasters, extreme weather, government restrictions, venue closures or other unforeseen emergencies.

Where reasonably possible, we will communicate with the Client and attempt to arrange an alternative date or appropriate solution.

22. WEDDINGS & EVENTS

For weddings and events, the Photographer cannot guarantee that every guest, moment, decoration or activity will be photographed.

The Client should provide the Photographer with information regarding important moments, schedules and specific photographs before the event.

The Photographer is not responsible for missed photographs caused by circumstances outside their reasonable control, including guests blocking photographs, venue restrictions, schedule delays or other service providers interfering with photography.

23. CLIENT CONDUCT & SAFETY

The Photographer reserves the right to stop or refuse to continue a session where the Photographer, staff, equipment, Client or members of the public are placed at unreasonable risk.

Abusive, threatening, discriminatory, violent or inappropriate behaviour toward the Photographer or team members will not be tolerated.

24. PERSONAL INFORMATION

Personal information collected during the booking process will be handled in accordance with applicable South African privacy laws, including the Protection of Personal Information Act (POPIA), where applicable.

Information may be used for purposes reasonably connected to providing photography services, processing bookings, communicating with Clients and maintaining necessary business records.

25. PACKAGE CHANGES & ADDITIONAL SERVICES

Any service not included in the selected package may attract an additional fee.

This may include additional shooting time, extra edited photographs, advanced retouching, prints, albums, additional locations, additional photographers, expedited editing, travel or other requested services.

Additional services should be agreed upon before they are provided.

26. PRICES

Prices displayed on our website, quotations or marketing materials may change from time to time.

Once a booking has been confirmed, the agreed price for that booking will apply unless the Client requests additional services or changes the original booking.

27. COMPLAINTS

If you are dissatisfied with any aspect of our service, please contact us as soon as reasonably possible and provide details of your concern.

We will make reasonable efforts to investigate and resolve legitimate concerns fairly.

28. SOUTH AFRICAN LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Nothing contained in these Terms is intended to remove or limit any rights or remedies that a consumer may have under applicable South African legislation, including the Consumer Protection Act, where applicable.

29. ACCEPTANCE OF TERMS

By confirming a booking and/or making payment, the Client acknowledges that they have had an opportunity to review these Terms & Conditions and agrees to be bound by them, subject to applicable law.
